Right to Cure in a Commercial Lease

In a perfect world, your business will thrive and you’ll make so much money that you won’t have to worry about paying your rent or bills; however, we do not live in a perfect world. There may be an occasion that you are late in paying your rent or other payments as required by the lease.

A Right to Cure provision will allow you some leeway before a landlord can claim that you are in breach or default of the lease. We don’t recommend abusing this provision; however, including a Right to Cure provision will alleviate some of the stress that comes with owning a business. A Right to Cure provision could give you an additional ten (10) to thirty (30) days to make a rent payment, which would allow you to cure the breach and get out of a default of the lease.
